Apple paid out the settlement to a class-action lawsuit against it over an alleged design defect in its Powerbeats 2. Some customers who bought the sports earphones alleged it stopped working and holding a charge after “minimal usage”.
Apple agreed to pay $9.75 million as part of the settlement. Class members who submit their claims forms will split the money after deducting the lawyers’ fees and other costs.
The plaintiffs filed the lawsuit in 2017, alleging that the earphones were “shoddy” and also accusing Apple of falsely advertising the Powerbeats 2 as “built to endure.”

The suit further accuses Apple of misrepresenting the battery life of the Powerbeats 2. It was also alleged that the Powerbeats 2 was advertised as sweat and water-resistant. The company was also accused of not repairing or replacing defective Powerbeats 2 within the warranty period.
The case however did no go to ruling as Apple instead opted to settle the case out of court, paying $9.7 million. It still denies all allegations but will pay the settlement fee to avoid expensive litigation.
According to the details sent out to Powerbeats 2 owners, customers who bought new Apple Powerbeats 2 earbuds before 7th August 2020 can claim payment from the settlement. But, the Superior Court of the State of California, Santa Clara County, has to approve it first.
Eligible individuals must submit their claim forms on or before 20th November 2020 to be part of the settlement. You can submit your claim online via the settlement website.
